aethvoxreturns@seznam.cz1.3 These Terms and Conditions govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter the "Civil Code"), the mutual rights and obligations of the Seller and a buyer who is a consumer (hereinafter the "Buyer") arising in connection with the conclusion of a contract of sale through the online shop at www.aethvox.store (hereinafter the "Online Shop"). The Seller sells clothing and fashion accessories under the AETHVOX brand through the Online Shop.
1.4 These Terms and Conditions do not apply to buyers who purchase goods in the course of their business activities or independent professional practice. Relationships with such buyers are governed by the Civil Code and by an individual agreement with the Seller.
1.5 Provisions deviating from these Terms and Conditions may be agreed in the contract of sale. Any such provisions shall take precedence over these Terms and Conditions.
2. USER ACCOUNT2.1 Following registration on the website, the Buyer may access their user interface. The Buyer may use this interface to place orders for goods (hereinafter the "User Account"). If the Online Shop’s web interface allows it, the Buyer may also order goods directly through the web interface without registering.
2.2 When registering on the website and ordering goods, the Buyer is required to provide all information correctly and truthfully. The Buyer must update the information provided in the User Account whenever it changes. The Seller considers the information provided by the Buyer in the User Account and when placing an order to be correct.
2.3 Access to the User Account is secured by a username and password. The Buyer must keep confidential all information necessary to access their User Account.
2.4 The Buyer is not entitled to allow third parties to use the User Account.
2.5 The Seller may cancel the User Account, in particular if the Buyer has not used it for more than [time period], or if the Buyer breaches their obligations under the contract of sale (including these Terms and Conditions).
2.6 The Buyer acknowledges that the User Account may not be available continuously, particularly due to necessary maintenance of the Seller’s hardware and software, or the hardware and software of third parties.
3. CONCLUSION OF THE CONTRACT OF SALE3.1 All goods displayed in the Online Shop’s web interface are for information purposes only, and the Seller is not obliged to enter into a contract of sale in respect of those goods. Section 1732(2) of the Civil Code shall not apply.
3.2 The Online Shop’s web interface contains information about the goods, including the price of each item and the costs of returning goods where, by their nature, they cannot be returned by ordinary post. The prices of goods include value added tax (VAT) and all related charges. The prices remain valid for as long as they are displayed in the Online Shop’s web interface. This provision does not limit the Seller’s ability to enter into a contract of sale on individually agreed terms.
3.3 The Online Shop’s web interface also contains information about the costs associated with packaging and delivery. The information about packaging and delivery costs displayed in the Online Shop’s web interface applies only where the goods are delivered within the territory of the Czech Republic.
3.4 To order goods, the Buyer must complete the order form in the Online Shop’s web interface. The order form contains, in particular, information about:
3.4.1 the goods being ordered (the Buyer places the goods being ordered in the electronic shopping basket in the Online Shop’s web interface);
3.4.2 the method of payment for the purchase price, the requested method of delivery of the ordered goods; and
3.4.3 the costs associated with delivery of the goods (together referred to as the "Order").
3.5 Before submitting the Order to the Seller, the Buyer is given the opportunity to check and amend the information entered in the Order, including to identify and correct any errors made when entering data. The Buyer submits the Order to the Seller by clicking the "Complete Order" button. The Seller considers the information provided in the Order to be correct. Upon receipt of the Order, the Seller shall promptly acknowledge receipt by email to the email address provided by the Buyer in their User Account or in the Order (hereinafter the "Buyer's Email Address").
3.6 Depending on the nature of the Order (the quantity of goods, the purchase price, and the estimated delivery costs), the Seller is always entitled to ask the Buyer to confirm the Order additionally (for example, in writing or by telephone).
3.7 The contractual relationship between the Seller and the Buyer is established when the Seller’s acceptance of the Order is delivered to the Buyer by email, sent to the Buyer’s email address.
3.8 The Buyer agrees to the use of means of distance communication when concluding the contract of sale. Any costs incurred by the Buyer in using means of distance communication in connection with the conclusion of the contract of sale (internet connection costs and telephone call charges) shall be borne by the Buyer, and shall not differ from the standard rates.
4. PRICE OF GOODS AND PAYMENT TERMS4.1 The Buyer may pay the Seller for the price of the goods and any delivery costs under the contract of sale by the following methods:
— in cash on delivery, at the place specified by the Buyer in the Order;
— by bank transfer in CZK to account No. 6 252 989 043/0800 (IBAN: CZ31 0800 0000 0062 5298 9043), held with Česká spořitelna, a.s.; BIC (SWIFT): GIBACZPX;
— cashlessly through the PayPal or GoPay payment system;
— by payment card;
— by means of credit provided by a third party.
4.2 In addition to the purchase price, the Buyer must also pay the Seller the agreed costs associated with packaging and delivery of the goods. Unless expressly stated otherwise, the purchase price shall also mean the costs associated with delivery of the goods.
4.3 The Seller does not require the Buyer to make a deposit or any similar advance payment. This does not affect the provision of Article 4.6 of these Terms and Conditions concerning the obligation to pay the purchase price in advance.
4.4 For cash payments or cash-on-delivery payments, the purchase price is payable upon receipt of the goods. For cashless payments, the purchase price is payable within 30 days of the conclusion of the contract of sale.
4.5 For cashless payments, the Buyer must pay the purchase price of the goods using the relevant payment reference (variable symbol). For cashless payments, the Buyer’s obligation to pay the purchase price is fulfilled when the relevant amount is credited to the Seller’s account.
4.6 The Seller is entitled, in particular where the Buyer has not provided additional confirmation of the Order (Article 3.6), to require the full purchase price to be paid before the goods are dispatched to the Buyer. Section 2119(1) of the Civil Code shall not apply.
4.7 Any discounts on the price of goods granted by the Seller to the Buyer may not be combined.
4.8 Where customary in commercial practice or required by generally binding legislation, the Seller shall issue the Buyer with a tax document — an invoice — in respect of payments made under the contract of sale. The Seller is not a VAT payer. The Seller shall issue the tax document — invoice — to the Buyer after the price of the goods has been paid and shall send it electronically to the Buyer’s email address.
4.9 Under the Act on the Registration of Sales, the Seller is obliged to issue a receipt to the Buyer. The Seller is also obliged to register the received payment online with the tax administrator; in the event of a technical outage, this must be done no later than within 48 hours.
5. WITHDRAWAL FROM THE CONTRACT OF SALE5.1 The Buyer acknowledges that, pursuant to Section 1837 of the Civil Code, it is not possible, among other things, to withdraw from a contract of sale for the supply of goods that have been customised according to the Buyer’s wishes or for the Buyer personally; goods that are perishable; goods that have been irreversibly mixed with other goods after delivery; goods supplied in sealed packaging which the consumer has removed from the packaging and which cannot be returned for hygiene reasons; or audio or video recordings or computer software where the original packaging has been broken.
5.2 Unless the case falls within Article 5.1 of these Terms and Conditions or another case in which withdrawal from the contract of sale is not permitted, the Buyer has the right, in accordance with Section 1829(1) of the Civil Code, to withdraw from the contract of sale within fourteen (14) days of receiving the goods. Where the contract of sale covers several types of goods or the delivery of several parts, this period shall run from the date on which the final delivery of goods is received. Notice of withdrawal from the contract of sale must be sent to the Seller within the period stated in the preceding sentence. The Buyer may use the model withdrawal form provided by the Seller, which forms an appendix to these Terms and Conditions. Notice of withdrawal may be sent, among other places, to the Seller’s business address or to the Seller’s email address:
aethvoxreturns@seznam.cz.
5.3 In the event of withdrawal from the contract of sale under Article 5.2 of these Terms and Conditions, the contract of sale shall be cancelled from the outset. The Buyer must return the goods to the Seller within fourteen (14) days of the notice of withdrawal from the contract of sale being delivered to the Seller. If the Buyer withdraws from the contract of sale, the Buyer shall bear the costs of returning the goods to the Seller, including where the goods cannot, by their nature, be returned by ordinary post.
5.4 In the event of withdrawal from the contract of sale under Article 5.2 of these Terms and Conditions, the Seller shall refund the payments received from the Buyer within fourteen (14) days of the Buyer’s withdrawal from the contract of sale, using the same method of payment as that used to receive the payment from the Buyer. The Seller is also entitled to refund the payment when the Buyer returns the goods or by another method, provided that the Buyer agrees and no additional costs are incurred by the Buyer. If the Buyer withdraws from the contract of sale, the Seller is not obliged to refund the payments received before the Buyer has returned the goods or provided proof that the goods have been sent back to the Seller.
5.5 The Seller is entitled to unilaterally set off any claim for compensation for damage to the goods against the Buyer’s claim for a refund of the purchase price.
5.6 In cases where the Buyer has the right to withdraw from the contract of sale under Section 1829(1) of the Civil Code, the Seller is also entitled to withdraw from the contract of sale at any time up until the Buyer has taken delivery of the goods. In such a case, the Seller shall refund the purchase price to the Buyer without undue delay, by cashless transfer to an account designated by the Buyer.
5.7 If a gift is provided to the Buyer together with the goods, the gift agreement between the Seller and the Buyer is concluded subject to a condition subsequent: if the Buyer withdraws from the contract of sale, the gift agreement in respect of that gift shall cease to have effect, and the Buyer must return the gift provided together with the goods to the Seller.
6. TRANSPORT AND DELIVERY OF GOODS6.1 If the method of transport is agreed at the Buyer’s special request, the Buyer shall bear the risk and any additional costs associated with that method of transport.
6.2 If, under the contract of sale, the Seller is obliged to deliver the goods to a place specified by the Buyer in the Order, the Buyer is obliged to accept the goods upon delivery.
6.3 If, for reasons attributable to the Buyer, the goods must be delivered repeatedly or by a method other than that specified in the Order, the Buyer shall pay the costs associated with repeated delivery or with the alternative delivery method, as applicable.
6.4 Upon taking delivery of the goods from the carrier, the Buyer must check that the packaging is intact and immediately notify the carrier of any defects. If the packaging appears to have been tampered with in a way that indicates unauthorised access to the consignment, the Buyer is not required to accept the consignment from the carrier.
6.5 Any further rights and obligations of the parties relating to the transport of goods may be governed by the Seller’s separate delivery terms, if issued by the Seller.
7. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE7.1 The rights and obligations of the contracting parties in relation to rights arising from defective performance are governed by the relevant generally binding legislation (in particular Sections 1914 to 1925, Sections 2099 to 2117 and Sections 2161 to 2174 of the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended).
7.2 The Seller is liable to the Buyer for ensuring that the goods are free from defects upon receipt. In particular, the Seller is liable to the Buyer for ensuring that, at the time the Buyer takes delivery of the goods:
7.2.1 the goods have the characteristics agreed between the parties or, in the absence of such an agreement, the characteristics described by the Seller or the manufacturer, or those which the Buyer could reasonably expect having regard to the nature of the goods and the advertising carried out by them;
7.2.2 the goods are suitable for the purpose stated by the Seller for their use or for the purpose for which goods of that kind are normally used;
7.2.3 the goods correspond in quality or design to the agreed sample or model, where the quality or design was determined by reference to an agreed sample or model;
7.2.4 the goods are supplied in the appropriate quantity, measure or weight; and
7.2.5 the goods comply with the requirements of applicable legislation.
7.3 The provisions of Article 7.2 of these Terms and Conditions do not apply to goods sold at a reduced price in respect of a defect for which the reduced price was agreed; to wear and tear caused by normal use; to used goods in respect of a defect corresponding to the degree of use or wear and tear that the goods had when received by the Buyer; or where this follows from the nature of the goods.
7.4 If a defect becomes apparent within six months of receipt, the goods shall be presumed to have been defective at the time of receipt. The Buyer is entitled to exercise rights in respect of a defect that occurs in consumer goods within twenty-four months of receipt.
7.5 The Buyer shall exercise rights arising from defective performance with the Seller at the Seller’s business premises, where complaints can be accepted having regard to the range of goods sold, or, where applicable, at the Seller’s registered office or place of business.
7.6 The Seller’s complaints procedure may set out further rights and obligations of the parties relating to the Seller’s liability for defects.
8. OTHER RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES8.1 Ownership of the goods passes to the Buyer upon payment of the full purchase price of the goods.
8.2 The Seller is not bound in relation to the Buyer by any codes of conduct within the meaning of Section 1826(1)(e) of the Civil Code.
8.3 The Seller handles consumer complaints via the email address
aethvox@seznam.cz. The Seller shall send information about the outcome of the Buyer’s complaint to the Buyer’s email address.

8.6 The Seller is authorised to sell goods on the basis of a trade licence. Trade licensing supervision is carried out by the competent Trade Licensing Office within its remit. Supervision of the area of personal data protection is carried out by the Office for Personal Data Protection. Within its defined scope, the Czech Trade Inspection Authority also supervises, among other matters, compliance with Act No. 634/1992 Coll., on Consumer Protection, as amended.
8.7 The Buyer hereby assumes the risk of a change in circumstances within the meaning of Section 1765(2) of the Civil Code.
9. PERSONAL DATA PROTECTION9.1 The Seller fulfils its information obligation towards the Buyer under Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter the "GDPR"), in connection with the processing of the Buyer’s personal data for the purposes of performing the contract of sale, negotiating that contract and fulfilling the Seller’s obligations under public law, by means of a separate document.

10.2 The Buyer agrees to the storage of so-called cookies on their computer. If a purchase can be made on the website and the Seller’s obligations under the contract of sale can be fulfilled without storing cookies on the Buyer’s computer, the Buyer may withdraw the consent referred to in the preceding sentence at any time.
11. SERVICE OF NOTICES11.1 Notices may be delivered to the Buyer at the Buyer’s email address.
12. FINAL PROVISIONS12.1 If the relationship established by the contract of sale contains an international (foreign) element, the parties agree that the relationship shall be governed by Czech law.
12.2 The choice of law under Article 12.1 of these Terms and Conditions does not deprive the consumer of the protection afforded by provisions of the legal system from which the parties may not derogate by agreement and which, in the absence of a choice of law, would otherwise apply pursuant to Article 6(1) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I).
12.3 If any provision of these Terms and Conditions is or becomes invalid or ineffective, the invalid or ineffective provision shall be replaced by a provision whose meaning most closely reflects that of the original provision.
